Defendant Infiniti of Clarendon Hills, Inc. ("Infiniti") has agreed to pay up to $552,600.00 a settlement fund from which eligible persons (“Settlement Class Members”) who file a valid Claim Form will receive $150.00 per person. Settlement Class Members need only to submit one Claim Form to receive payment for all text messages and calls that Settlement Class Member received. Infiniti is an automotive dealership located in Clarendon Hills, Illinois.

The Settlement resolves a lawsuit involving allegations that class members received text messages and calls sent by or on behalf of Infiniti within a 12-month period while their telephone numbers were listed on the National Do Not Call Registry for at least thirty days in alleged violation of the Telephone Consumer Protection Act (“TCPA”). Infiniti denies all allegations of wrongdoing in the lawsuit. As part of the proposed settlement, Infiniti does not admit to any wrongdoing and continues to deny the allegations against it. The Court has not decided who is correct.
